Public Agreement

By getting a proxy servers by any way (buying in online shop, getting from web pages with a proxy servers for testing, buying a proxy directly from us in any way, etc.), you accept and completely agree the following:

Our proxies and our service are provided "as is" and any expressed or implied agreements, warranties, discussions, declarations about quality of proxies or our service including but not limited to: warranties of merchantability, compliance for any expectations, fitness for any purposes are disclaimed.

We have ZERO tolerance with SPAM. If you have received e-mail with advertising of our web site, you should report us about it.

You know what is public proxy all specific information about work with public proxies and proxy-related terminology, accept all risks of working with public proxies and agree all potential consequences of using or impossibility of using public proxies.

The present Agreement (called in the further as "Agreement") adjusts attitudes relations between company FreeProxy Inc.(called in the further as "Seller") and the buyer / the user of a proxy servers (called in the further as "Buyer").

This is the final agreement which replaces with itself all previous agreements, discussions, statements and applications.

1. The subject of the User Agreement
The Seller offers the Buyer his service on the conditions being a subject of the present Agreement. The agreement can be changed by the Seller without any special notice. The most actual version of the Agreement is always available on the page http://www.freeproxy.ru/en/buy/agreement.htm

2. The description of services
Service of granting access to lists of public proxy servers of company FreeProxy Inc. - is a service which provides access to lists of proxy servers on a paid and free-of-charge basis.
Services of access to lists of public proxy servers are given the Buyers who have access to a network Internet and having the software, which allowes to work with proxy servers.
Now the Seller doesn't sell private proxy servers lists in any form.

3. General provisions
The agreement is legally obliging contract between the Buyer and company FreeProxy Inc. and also regulates the use by the Buyer of service of access to lists of public proxy servers.

4. The introduction of the Agreement valid
The agreement inures by expression the User of the consent with their conditions in the form of buing or receiving (in any way) lists of the proxy servers.

5. Rights of the sides
5.1 Rights of the Seller.
The Seller has the right to terminate relations with the Buyer (stop all subscriptions, stop procedure of proxies purchase, etc.) in case of infringement of the present Agreement by the last party
The Seller reserves the right to itself temporarily to suspend or stop granting services, in due time having notified about it the Buyers.
The Seller can don't allow to suspend subscription for the Buyer. In this case problem can be solved by negotiations.

5.2 Rights of the Buyer.
The Buyer can temporary suspend paid subscription for the proxies or inform the Seller about date of beginning subscription / purchase proxies. All conditions of suspending should be discussed with the Seller. The subscription can be suspended not more than 2 times per month.

6. Obligations of the sides
6.1 Obligations of the Seller.
The Seller undertakes to give access to Buyers to the lists of public proxy servers and to support serviceability of web sites for receiving these lists 7 days in a week.
The Seller reserves the rights to itself to make changes in conditions of the present Agreement by publication of the new version of the Agreement on the web site. The new Agreement inures in 3 days term from the moment of the publication on a site.

6.2 Obligations of the Buyer
The buyer understands and accepts, that he bears the full responsibility of knowledge of the features of work with a proxy servers, takes up all possible risks or losses from use or impossibility of use of public proxy servers. The Seller does not supervise in what way the lists of proxy servers given by him will be used. Under any circumstances the Seller does not bear the responsibility for the damage caused by Buyers with the use given by him proxy servers. The Buyer agrees not to use the service given to it him by the Seller for the illegal purposes which are included (but are not limited):

Infringement of the rights of minor persons and/or causing of harm them in any form;
Dispatches of the SPAM;
Infringements of normal work of the network and its units.

In case of purchase by the Buyer of access to a hourly subscription to proxy servers the Buyer agrees to not create excessive loading on the server of the Seller by numerous downloads of proxylists. The amount of downloads of the Buyer should not exceed a limit: on the average 1 time download each 15-20 minutes (or up to 100 downloads per day).

Before make any buying of proxies the Buyer should test quality of proxies by using one of free fragments of proxylists of the Seller. The Buyer should test quality of proxies as many times as need, to make sure in quality of proxies. If the Buyer want to buy hourly subscription, the Seller strongly recommend to buy fresh proxylist in Online Shop before purchase subscription to test quality of service.

7. Proxy's delivery
If you are buying/getting proxies by using non-automated ways (without using automated payment / proxy's delivery systems) you will receive proxies during 1-5 business days after receiving money by the Seller (if you transfer money through a bank - during 1-7 business days after receiving notification by Seller from a bank), if other delivery period doesn't specified by Seller during a buying a proxies. This period can be only longer than 1-5 business days. The Seller can deliver proxies faster than 1-2 business days but Seller can't guarantee this delivery speed and Buyer can't demand it from the Seller.

8. Rights of reselling /redistributing proxies
The Buyer agrees not to sell, not to resell and don't distribute in any form the lists of public proxy servers given to it him, except of the cases when such sanction in the obvious form is given to the Buyer. The seller does not bear any responsibility under any contracts between the Buyer and the third parties.

9. The property rights
The Buyer understands and agrees that service given to it him and all necessary programs are protected by copyrights, laws on the intellectual property and other corresponding Russian and international laws.

10. Clearing of guarantees
The Buyer understands and agrees that:
10.1 ALL given by the Seller proxy servers are free-of-charge and public, i.e. the Seller does not guarantee (and cannot guarantee in any kind or the form) their serviceability, or conformity or discrepancy to the purposes, expectations or requirements of the Buyer.
10.2 The Seller does not guarantee, that service of access to public proxy servers will be given continuously, quickly, reliably and without mistakes; results which can be received with use of service of the Seller, will be exact and reliable; quality of any product, service, the information and etc., received with the use of the service of the Seller, will meet the expectations of the Buyer; all mistakes in the programs / scripts will be corrected.
10.3 The Seller is not responsible for any direct or indirect losses which have occurred because of: uses or impossibility of use of the service; the non-authorized access to the communications of the Buyer; statements or behaviour of any third party within the framework of service.
10.4 The Seller gives access to public proxy servers. The proxies don't test for bulk emails, presence in any "black lists" (RBL), logs, 100% stability of working, etc. The Seller also don't give any guarantees, related with any of these properties of proxies.
10.5 The Buyer agree and understands, that generally the concept "working" is not equivalent to concept "tested" or "recently tested". It means, that on serviceability of a proxy server influence a great amount of factors which the Seller is not capable to supervise, switching (but not being limited):
- The general loading / serviceability/options of a network, or its any sites (including a site (ISP) where the Buyer and a site, where the proxy server is located);
- Settings of the proxy server which can let or forbid access from various subnets or to various networks;
- Time of day during which there is a accessing to a proxy;
- The period between the moment of successful check of a proxy (the moment when the proxy was working) and the moment when it was received by the Buyer.

11. Additional conditions of purchase of hourly subscription for proxies and purchase proxies lists in Online Shop
The Buyer agrees and accepts that the Seller can't control of when, where and how (by using what software) the Buyer gets access to proxies in hourly subscription or when the Buyer activates PIN code bought in Online Shop. So, the Seller don't respond (in any form) if the Buyer didn't request proxies in hourly subscription (during any period of subscription or during all time of subscription) or didn't activate PIN code bought in Online Shop. In case of hourly subscription the Buyer can, by using received information from the Seller, get access to tested proxies. When period of hourly subscription ends, access to proxies will be closed.
The Seller don't respond if the Buyer buy PIN code in Online Shop and didn't activate it during 1 week (7 days) after purchase. In this case the Seller can delete PIN code so the Buyer can't access the proxies by using this code.

12. Additional information (buyers FAQ):
What is "the proxies accumulated during a... "?
We check every day tens of thousands proxies. And the proxies that successfully tested (working) save in archive (and they don't delete later). For example, the list of the proxy which have accumulated during a week, contains 7 daily archives - from Monday to Sunday inclusive. Actually, we sell archives of a proxies: archive of a proxies for today, for a week, for a month, for all time of existence of the project (the full proxies list ).
You sold "mail-enabled proxies". Now what you can tell about your proxies?
Now our proxies are test only for proxy protocol support: HTTP, HTTPS, SOCKS4/5. Now we don't test proxies for connecting to mail servers, presence in RBL, etc. - and of course, we don't give any guarantees about it. All proxies are just opened and public.
Why even in "freshest" proxylists can be founded non-working proxies?
